ORDINANCE NO. BL2008-125

An ordinance abandoning a 10” sanitary sewer line and easement and accepting a replacement 8” sanitary sewer line and easement in connection with Project 07-SL-132/07-WL-0089 that is shown on Map 093-05, Parcels 153, 154, and 157, YMCA Downtown, 213 and 211 McLemore Street, and 1000 Church Street and authorizing the execution of the documents to carry out the abandonment (Proposal No. 2007M-143U-9).

WHEREAS, a 10” existing sanitary sewer line and accompanying easement, more particularly described in Project No. 07-SL-132/07-WL-0089, YMCA Downtown, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2007M-143U-9 on July 19, 2007 for abandonment of said easement and sanitary sewer line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the sanitary sewer line and the easement shown on Map 093-05, Parcels 153, 154, and 157, Project No. 07-SL-132/07-WL-0089, as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: Any further amendments to this Legislation may be processed by Resolution.

SECTION 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:

I move to amend Ordinance No. BL2008-125 by amending Section 1 as follows:
1. By adding after the phrase “as indicated on Exhibit 1 hereto,” the phrase “and accepts the donation of the replacement sewer line and easement as shown on Exhibit 1,”.

2. By deleting the word “abandonment” and substituting in lieu thereof the work “transactions”.
