ORDINANCE NO. BL2008-123

An ordinance abandoning a 36” sanitary sewer line and easement and accepting a replacement 42” sanitary sewer line and easement in connection with Project 05-SL-116, that is shown on Map 090, Parcels 05.00 and 05.01 and Map 090-04, Parcels 007 and 008, Project 05-SL-116, Reo Stone, 711 and 703 Basswood Avenue, 6614 Robertson Avenue, and Spencer Avenue and authorizing the execution of the documents to carry out said transactions (Proposal No. 2005M-213U-07).

WHEREAS, a 36” existing sanitary sewer line and accompanying easement, as shown in the document attached as Exhibit 1 and incorporated into this ordinance by reference, and more particularly described in the plans for Project No. 05-SL-116, Reo Stone, on record in the Department of Water and Sewerage Services are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, Reo Stone proposes to donate a replacement 36” sewer line and easement, also shown on the plans for Project No. 05-SL-116 and on Exhibit 1.

WHEREAS, on November 15, 2005, the Metropolitan Planning Commission approved this transactions contemplated by this ordinance pursuant to mandatory referral No. 2005M-213U-07.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the sanitary sewer line and the easement shown on Map 090, Parcels 05.00 and 05.01 and Map 090-04, Parcels 007 and 008, Project 05-SL-116, Reo Stone, further shown on Exhibit 1 to this ordinance, and accepts the donation of the replacement sewer line and easement also appearing thereon, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the transactions authorized by this ordinance.

SECTION 2: Any further amendments to this Legislation may be processed by Resolution.

SECTION 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
