ORDINANCE NO. BL2008-122

An ordinance abandoning an 8” water line and easement and accepting a replacement 8” water line and easement in connection with Project 07-WL-0091 that is shown on Map 091-13, Parcels 296 and 297, 5920 and 5934 O'brien Avenue, Haven West Townhomes Water Relocation and authorizing the execution of the documents to carry out said transactions (Proposal No. 2007M-189U-7).

WHEREAS, an 8” existing water line and accompanying easement, more particularly described in Project No. 07-WL-0091, Haven West Town homes Water Relocation, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2007M-189U-7 on September 10, 2007 for abandonment of said easement and water line.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the water line and the easement shown on Map 091-13, Parcels 296 and 297, Project 07-WL-0091, Haven West Town homes Water Relocation, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: Any further amendments to this Legislation may be processed by Resolution.

SECTION 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
