ORDINANCE NO. BL2008-118

An ordinance amending Chapters 10.26 and 10.28 of the Metropolitan Code to prohibit the excessive accumulation of mulch on residentially-zoned property.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Section 10.26.080 of the Metropolitan Code is hereby amended by adding the following new subsection C.:

“C. No owner or occupant of any residentially-zoned property one-half (1/2) acre in size or greater shall permit more than five percent (5%) of the lot area to be covered with mulch. The excessive accumulation of mulch as a fill material is declared to be a public nuisance and a danger to the public health, safety and welfare.”

Section 2. Section 10.28.080 of the Metropolitan Code is hereby amended by adding the following new subsection C.:

“C. No owner or occupant of any residentially-zoned property one-half (1/2) acre in size or greater shall permit more than five percent (5%) of the lot area to be covered with mulch. The excessive accumulation of mulch as a fill material is declared to be a public nuisance and a danger to the public health, safety and welfare.”

Section 3. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:

I move to amend Ordinance No. BL2008-118 by deleting the Code section number “10.26.080”, wherein it appears in Section 1, and substituting in lieu thereof the Code section number “10.26.010”.
