ORDINANCE NO. BL2008-112

An ordinance approving the disposition of certain parcels of surplus property by the Director of Public Property listed as Davidson County Tax Map 086, Parcels 754 and 755 (Proposal No. 2007M-122G-14A-B).

Whereas, The Metropolitan Government of Nashville and Davidson County owns certain parcels of property, listed as Davidson County Tax Map 086, Parcels 754 (Exhibit A) and 755 (Exhibit B); and

Whereas, Metro Water Services acquired said parcel through a quit claim deed, as a result of Metro Water Services acquisition of the First Suburban Water Utility District of Davidson County, Tennessee; and

Whereas, The Metropolitan Government has determined that said parcels of property are no longer needed for governmental purposes.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the parcels, listed as Davidson County Tax Map 086, Parcels 754 and 755 owned in fee by the Metropolitan Government, are surplus.

Section 2. That the Director of Public Property is hereby authorized and directed to sell said property in accordance with the Standard Rules and Regulations for the disposition of surplus real property.

Section 3. That the proceeds from the sale of said parcels of property shall be credited to the Metropolitan Water and Sewerage Services Department Revenue Fund.

Section 4. That the Metropolitan Government of Nashville and Davidson County retains any requisite easements to utilities located on the property.

Section 5. That in the event there is proposed any construction over, above, or under easements in the surplus parcel of property, said construction shall require the approval of the Director of Water and Sewerage Services.

Section 6. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
