ORDINANCE NO. BL2008-111

An ordinance amending Title 3 of the Metropolitan Code pertaining to health insurance benefits for members of the Metropolitan Council, all of which is more particularly described herein.

WHEREAS, Section 3.24.010(B) of the Metropolitan Code allows elected officials holding office for eight years or more to continue coverage in the Metropolitan Government comprehensive health care plan provided they pay the contribution rates equivalent to those rates paid by the Metropolitan Government employees; and

WHEREAS, the Metropolitan Department of Law has opined that Section 3.24.010(B) would not allow an elected official who has served less than eight years, but who is ineligible to serve a third consecutive term pursuant to the Metropolitan Charter term limit provisions, to continue to receive subsidized health insurance benefits after he/she leaves office; and

WHEREAS, the Metropolitan Employee Benefit Board at its November 2007 meeting unanimously approved a motion requesting the Metropolitan Council to swiftly and promptly address Code Section 3.24.010(B) for elected officials adversely impacted with regard to continuing participation in Metro’s subsidized health insurance plans; and

WHEREAS, the Metropolitan Council deems it appropriate to amend Chapters 3.16 and 3.24 to clarify that Members of Council are entitled to participate in the subsidized health care plan and to allow term-limited elected officials to continue coverage in the subsidized health care plan.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Section 3.16.040 of the Metropolitan Code is hereby amended by deleting subsection B. in its entirety.

Section 2. Section 3.24.010 of the Metropolitan Code is hereby amended by relettering the existing subsection C. as subsection D., and adding the following new subsection C.:

“C. Council member participation in the comprehensive health care plan.
1. Members of the metropolitan council, during their term of office, shall be authorized to participate in the health insurance program under the same terms and conditions as are available for regular metropolitan government employees. The benefits and contribution rates shall be equivalent to those benefits and rates paid by metropolitan government employees. Each member of council shall have the option of participating in the program by notifying the employee benefit board of their desire to participate in the program at any time during their term of office.
2. Members of council who were participants in the comprehensive health care plan during the time they held office may elect to continue the health care plan, provided they pay the full amount of the premium without any subsidy from the Metropolitan Government. Notwithstanding the foregoing provision, those members of council holding office for eight (8) years or more, and those members of council serving on or after August 31, 2007, that have served part of one term and a full consecutive term and are prohibited from serving a third consecutive term pursuant to Section 1.07 of the Metropolitan Charter, may elect to continue the health care plan, provided they pay the contribution rates equivalent to those rates paid by Metropolitan Government employees.”

Section 3. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
