ORDINANCE NO. BL2007-81

An ordinance authorizing the Metropolitan Government to participate with Cates-Kottas Development, to provide public sewer service in Williamson County to Benington Subdivision, Section 4, Project No. 06-SL-183.

WHEREAS, Cates-Kottas Development, has expressed a desire to provide public sewer service in Williamson County, Tennessee, to a development known as Benington Subdivision, Section 4, Project No. 06-SL-183; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, has built the Mill Creek Trunk Sewer Project No. 98-SG-13 anticipating participation from developers at $2,000.00 per connection towards the cost of the Project; and

WHEREAS, this Project is deemed to benefit both parties and the general community, and Cates-Kottas Development , agrees to pay an amount not to exceed $70,000.00 for a total of 35 single-family home connections.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The participation agreement with Cates-Kottas Development , to provide public sewer services in Williamson County, Tennessee, known as Benington Subdivision, Section 4, , Project No. 06-SL-183, attached hereto and incorporated herein, is hereby approved, and the Director of Water and Sewer Services is authorized to execute the same.

SECTION 2. That the $70,000.00 from Benington Development, Section 4 will be deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No.47335.

SECTION 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
