ORDINANCE NO. BL2007-79

An ordinance amending Chapter 13.20 of the Metropolitan Code pertaining to the control of traffic in temporary work zones.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 13.20.030 of the Metropolitan Code is hereby amended by deleting subsection C. in its entirety and substituting in lieu thereof the following new subsection C.:

“C. Temporary work zones and traffic control devices.
1. In connection with the issuance of a permit under this chapter, the director may install, or may require installation and maintenance of, traffic-control devices. Such devices and their placement shall meet the requirements of the latest edition of the Manual for Uniform Traffic Control Devices (MUTCD).
2. All traffic control in a temporary work zone shall be performed either by:
(a) off-duty metropolitan Nashville police officers; or
(b) persons who have been trained in proper temporary traffic control practices and have a basic understanding of the principles contained in the MUTCD.
3. Prior to issuing a permit pursuant to this chapter, if the director determines that traffic control devices are necessary in a temporary work zone, the permit holder shall submit to the director a sworn affidavit on a form approved by the director that the permit holder has sufficient trained personnel on staff or under contract to supervise the selection, placement, and maintenance of temporary traffic control devices.
4. Notwithstanding the provisions of subsection C.2. of this section to the contrary, only off-duty metropolitan Nashville police officers, or persons trained by the metropolitan Nashville police department, shall be used if temporary work zones require the manual direction of motorized traffic through a signalized intersection, stop sign or similar traffic control device.”

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
