An ordinance abandoning easement rights that were retained, that is shown on an unnumbered Alley located between Thompson Lane and Collier Drive and authorizing the execution of the documents to carry out the abandonment (Proposal No. 2007M-191U-11).

WHEREAS, an existing unnumbered Alley, more particularly described in Project No. 07-SL-0189, Action Nissan, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2007M-191U-11 on September 26, 2007 for abandonment of said easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the easement shown on an unnumbered Alley located between Thompson Lane and Collier Drive, Project No. 07-SL-0189, Action Nissan, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: Any further amendments to this Legislation may be processed by Resolution.

SECTION 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
