An ordinance abandoning a public utility easement located at Alley # 1894 and authorizing the execution of any documents necessary to carry out the abandonment (Proposal No. 2007M-068U-11).

WHEREAS, an existing public utility easement, shown in Exhibit 1 hereto and more particularly described in Project No. 07-SC-0080, Alley # 1894 Abandonment, on record in the department of Water and Sewerage Services and incorporated herein by reference, is no longer being used by the Department of Water and Sewerage Services or any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved the abandonment of the described public utility easement as this mandatory referral No. 2007M-068U-11 on April 19, 2007.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: The Metropolitan Government hereby abandons the public utility easement located in Alley # 1894, Project No. 07-SC-0080, Alley # 1894 Abandonment, as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: Any further amendments to this ordinance shall be by resolution.

SECTION 3: This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
