ORDINANCE NO. BL2007-53

An ordinance authorizing the acquisition of property by negotiation and acceptance for the purpose of acquiring easements, pumps and appurtenances for use in public projects of the Metropolitan Government, initially with relation to grinder pumps located at 107 Edgebrook Road, 2225 Kayla Drive, 2225, 2217, 2205, 2220, 2221 and 2232 Seven Points Circle, 500, 505, and 501 Pauls Trail, 308 Rachaels Meadow Court, 2165 Christina Court, and 2528 Miami Avenue.

WHEREAS, it is in the public interest that easements be acquired to permit the construction of or other use for water mains, sanitary sewers, reservoirs, stormwater and/or pumps and appurtenances within the area designated for the construction of those grinder pump projects.

WHEREAS, grants of certain easements have been executed by the respective property owners and offered to the Metropolitan Government of Nashville and Davidson County; and

WHEREAS, the easements are located on the property described in Exhibit 1 hereto; and,

WHEREAS, these projects have been authorized under Capital Improvements Budget No. 96SG0001; and

WHEREAS, the easements are further described in the Metropolitan Water and Sewerage Services Department’s plans on file for multiple grinder pump projects specified on Exhibit 1 hereto, and the easements are for the purposes of those grinder pump projects.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The Metropolitan Government of Nashville and Davidson County, by and through the Director of Public Property Administration is hereby authorized to accept from the respective property owners the easements described in the Metropolitan Water and Sewerage Services Department’s plans on file for certain grinder pump projects as specified on Exhibit 1 hereto, for the purposes of those grinder pump projects, and located on the property described in Exhibit 1 hereto, which plans and Exhibit are incorporated herein.

Section 2. The easements shall be filed in the Office of the Register of Deeds to evidence their acceptance.

Section 3. Any further amendments to this legislation may be processed by Resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
