ORDINANCE NO. BL2007-51

An ordinance authorizing the Metropolitan Government to participate with Ken Kelley Property to provide public sewer service in Williamson County, to Ken Kelley Property, Project No. 07-SL-143.

WHEREAS, Ken Kelley Property has expressed a desire to provide public sewer service in Williamson County, Tennessee, to a development known as Ken Kelley Property, Project No. 07-SL-143; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerages, has built the Mill Creek Trunk Sewer Project No. 98-SG-13 anticipating participation from developers at $2,000.00 per connection towards the cost of the Project; and

WHEREAS, This project is deemed to benefit both parties and the general community, and Ken Kelley Property agrees to pay an amount not to exceed $2,000.00, for one unit of flow.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The participation agreement with Ken Kelley Property, to provide public sewer services in Williamson County, Tennessee, to a development known as Ken Kelley Property, Project No. 07-SL-143, attached hereto and incorporated herein, is hereby approved and the Director of Water and Sewerage Services is authorized to execute the same.

SECTION 2. That the $2,000.00 from Ken Kelley Property will be deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No. 47335, for a total of one unit of flow.

SECTION 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
