ORDINANCE NO. BL2007-50

An ordinance authorizing the Metropolitan Government to participate with Burkitt Place Development LLC, to provide public sewer service in Davidson and Williamson County to Burkitt Place Phase 2A, 2B & 2G, Project No. 06-SL-67 and 06-SL-71.

WHEREAS, pursuant to the terms of the agreement attached as Exhibit A and incorporated into this ordinance by reference, Burkitt Place Development, LLC proposes to provide public sewer service in Davidson and Williamson County, Tennessee, to a development known as Burkitt Place, Phase 2A, 2B, & 2G, Project No. 06-SL-67 and 06-SL-71; and

WHEREAS, the Metropolitan Government, Department of Water and Sewerage Services, has built the Mill Creek Trunk Sewer Project No. 98-SG-13 anticipating participation from developers at $2,000.00 per connection towards the cost of the Project; and

WHEREAS, this Project is deemed to benefit both parties and the general community, and Burkitt Place Development LLC, agrees to pay an amount not to exceed $106,000.00 for a total of 53 single-family home connections.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The participation agreement attached as Exhibit A is hereby approved, and the Director of Water and Sewer Services is authorized to execute it on behalf of the Metropolitan Government.

SECTION 2. That the $106,000.00 from Burkitt Place Development LLC will be deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No.47335.

SECTION 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
