ORDINANCE NO. BL2007-110

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the SP district approved by Ordinance No. BL2006-1286 for property located at 6419 Pettus Road, at the end of Autumn Crossing Way, (28.99 acres), approved for 69 single-family lots and 64 multi-family units, to clarify the conditions pertaining to the required masonry component, all of which is described herein (Proposal No. 2006SP-112G-12).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by changing the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of Title 17 by reference, as follows:

By amending the SP district approved by Ordinance No. BL2006-1286 for property located at located at 6419 Pettus Road, at the end of Autumn Crossing Way, (28.99 acres), as being part of Property Parcel No. 052 as designated on Map 181-00 as designated on Map 181-00 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, approved for 69 single-family lots and 64 multi-family units, all of which is described by lines, words and figures on the plan that was duly considered by the Metropolitan Planning Commission, and which is on file with the Metropolitan Planning Department and made a part of this ordinance as though copied herein, to clarify the conditions pertaining to the required masonry component and to conform with the final SP site plan, which has been approved by the Planning Commission.

Section 2. That Ordinance No. BL2006-1286 is hereby amended by amending Section 3 by deleting paragraphs 6, 7 and 8 in their entirety and substituting in lieu thereof the following new paragraphs 6, 7 and 8:

“6. Brick, stone, or cultured stone shall be used on 100% of the front façade of the buildings, excluding non-structural, architectural features such as dormers, porch gables, etc.

7. Building walls at side elevations of single-family detached homes shall be brick, stone or cultured stone on the first floor. This requirement shall not apply to any structures other than single-family detached. This requirement will only apply to the two sides of the single-family detached drawings, and not to the front or the rear.
8. Single-family homes built on transition lots, as identified on the site plan, shall have 100% brick, stone, or cultured stone on the front façade of the building, excluding non-structural architectural features such as dormers, porch gables, etc. Building walls at all side elevations that are greater than one story shall have brick, stone or cultured stone in the top of the second floor, excluding gables. There is no required for brick, stone, or cultured stone on the rear.”

Section 3. Be it further enacted, that Ordinance No. BL2006-1286 is hereby amended by renumbering Section 4 as Section 5 and by adding the following new Section 4:

“Section 4. The appropriate representatives of the Planning Department and the Department of Codes Administration are authorized and directed to approve and issue all required Metro permits consistent with the terms of this amendatory ordinance.”

Section 4. Be it further enacted, that the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet No. 093 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

Section 5. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
