ORDINANCE NO. BL2007-1563

An ordinance authorizing the acquisition of certain properties at 16th Avenue North and Jo Johnston Street Map 92-08, Parcels, 26, 29, 30, 32 and 369 in fee simple by negotiation or condemnation.

WHEREAS, the Metropolitan Development and Housing Agency is undertaking the John Henry Hale redevelopment project; and

WHEREAS, MDHA has identified additional property in the immediate vicinity of Martin Luther King, Jr. Magnet School, Watkins Park and John Henry Hale necessary for the successful completion of the project; and

WHEREAS, Tennessee Code Annotated Chapter 13-20-101 et seq., authorizes MDHA to acquire properties through negotiation or condemnation subject to the approval of the Metropolitan Council; and

WHEREAS, the acquisition of certain property in Nashville and Davidson County, located at Map 92-08, Parcels, 26, 29, 30, 32 and 369 will help carry out the goals and objectives of the John Henry Hale redevelopment project.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Development and Housing Agency is hereby authorized to acquire certain property in Nashville and Davidson County, located at Map 92-08, Parcels 26, 29, 30, 32 and 369 in accordance with Tennessee Code Annotated Chapter 13-20-101 et seq. by negotiation or condemnation.

Section 2. This Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
