An ordinance approving an agreement and addendum by and between the Metropolitan Government of Nashville and Davidson County, the State of Tennessee, Department of Transportation, and the City of Belle Meade concerning repairs to a bridge on Hillwood Boulevard over Richland Creek and a railroad right of way.

WHEREAS, The Metropolitan Government of Nashville and Davidson County (“Metro”) and the City of Belle Meade (“Belle Meade”) have ownership interests in a certain bridge (the “Bridge”) on Hillwood Boulevard over Richland Creek and a railroad right of way; and

WHEREAS, the Bridge is in need of repairs (the “Project”); and

WHEREAS, pursuant to the terms of the Agreement attached to this ordinance as Exhibit A and incorporated by reference, the State of Tennessee, Department of Transportation, has proposed to manage the Project and to make available federal funds for a portion of the Project costs, Metro and Belle Meade being responsible for the remaining costs as set forth in the Agreement; and

WHEREAS, pursuant to the terms of the addendum to the Agreement attached to this ordinance as Exhibit B and incorporated by reference, Metro and Belle Meade seek further to allocate responsibility for Project costs; and

WHEREAS, approval of the Agreement and addendum is in the best interests of the citizens of Nashville and Davidson County.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. The Agreement (Exhibit A) and Addendum (Exhibit B) between the Metropolitan Government of Nashville and Davidson County, State of Tennessee and City of Belle Meade are hereby approved and the Director of the Department of Public Works is authorized to execute both on behalf of the Metropolitan Government.

SECTION 2. Any amendment to the Agreement must be approved by resolution of the Metropolitan Council.

SECTION 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
