ORDINANCE NO. BL2007-1558

An ordinance approving an agreement by and between the Metropolitan Government of Nashville and Davidson County and the Nashville Downtown Partnership concerning operation of certain parking facilities.

WHEREAS, the Metropolitan Government owns certain parking facilities in the downtown Nashville area; and

WHEREAS, pursuant to the terms of the agreement (the “Agreement”) attached as Exhibit A and incorporated into this ordinance by reference, the Metropolitan Government proposes to engage the Nashville Downtown Partnership to operate and manage the parking facilities therein described; and

WHEREAS, approval of the Agreement is in the best interests of the citizens of Nashville and Davidson County.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. The Agreement between the Metropolitan Government and the Nashville Downtown Partnership (Exhibit A) is hereby approved and the Director of Public Works or his designee is authorized to execute the agreement on behalf of the Metropolitan Government.

SECTION 2. Any amendment to the Agreement must be approved by resolution of the Metropolitan Council receiving at least 21 affirmative votes.

SECTION 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
