SUBSTITUTE ORDINANCE NO. BL2007-1518

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending a previously approved SP district on property located at 110, 112, 114, 116, 118 and 120 Woodmont Boulevard, and 111, 113 and 115 Kenner Avenue, approximately 550 feet east of Harding Pike (2.58 acres), to add four properties (0.92 acres) to the original SP district and to amend the provisions of the original SP district to permit 34 multifamily units and 7 single-family lots, all of which is more particularly described herein, (Proposal No. 2005SP-168U-10).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by making certain changes in the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of Title 17 by reference, as follows:

By amending a previously approved SP district on property located at 110, 112, 114, 116, 118 and 120 Woodmont Boulevard, and 111, 113 and 115 Kenner Avenue, approximately 550 feet east of Harding Pike (2.58 acres), to add four properties (0.92 acres) to the original SP district and to amend the provisions of the original SP district to permit 34 multifamily units and 7 single-family lots, as being Property Parcel Nos. 086, 087, 088, 138 as designated on Map 116-03 of Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is described by lines, words and figures on the attached plan that was duly considered by the Planning Commission, and which is on file with the Metropolitan Planning Department and made a part of this ordinance as though copied herein.

Section 2. Be it further enacted, that the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet No. 116
of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

Section 3. Be it further enacted that, a final corrected copy of the amended SP plan incorporating the conditions of approval by the Planning Commission and Council shall be provided to the Planning Department prior to the filing of any additional development applications for this property, and in any event no later than 120 days after the effective date of this ordinance. If a final corrected copy of the SP plan incorporating the conditions therein is not provided to the Planning Department within 120 days of the effective date of this ordinance, then the final corrected copy of the SP plan shall be presented to the Metro Council as a new amendment to the SP prior to approval of any grading, clearing, grubbing, final site plan, or any other development application for the property.

Section 4. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Amendment No. 1

Ordinance No. BL2007-1518

Mr. President:

I move to amend Ordinance No. BL2007-1518 by adding the following new Section 3 and renumbering the following sections of the Ordinance accordingly:

“Section 3. Be it further enacted that, the following conditions be completed, bonded or satisfied prior to the issuance of any permits, or specifically required in the condition:

1. This amendment is to add additional properties into the Woodmont Condos SP and does not change the previously approved SP plan for the new construction but will only address existing single-family residential structures which are within the SP district.

2. This amendment to the Woodmont Condos SP will also ensure that additions and new construction in the instance a single-family home in the district is destroyed will not contrast greatly with the size, scale, or material found with the existing single-family homes or the homes in the surrounding area. Additions and new construction shall meet the following conditions:
a. Additions shall be situated at the rear, and constructed in such a way that it will not disturb either front or side facades.
b. Additions shall not enclose front porches and front porches shall be maintained.
c. Additions shall use same or similar exterior building materials as present on existing buildings.
d. Additions shall not exceed 2 stories in height.
e. New construction foot print shall not exceed 25% of the lot area.
f. New construction shall not exceed 2 stories in height.
g. Shall have a front porch.
h. Shall be clad with brick or stucco. Other materials such as wood clapboard, cement fiber or other similar material may be used for accents and on gables.
