ORDINANCE NO. BL2007-1501

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the adopted Eastwood Neighborhood Conservation Overlay to include various properties along Douglas Avenue, Chapel Avenue, Matthews Place, Greenwood Avenue, Sumner Avenue, North 14th Street, North 16th Street, Setliff Place, McKennie Avenue, Sharpe Avenue, Straightway Avenue, Franklin Avenue, Gallatin Avenue, Benjamin Street, Benson Street and Eastland Avenue, (130.49 acres), all of which is more particularly described herein (Proposal No. 2007Z-123U-05).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by changing the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of Title 17 by reference, as follows:

By amending the adopted Eastwood Neighborhood Conservation Overlay to include various properties located along Douglas Avenue, Chapel Avenue, Matthews Place, Greenwood Avenue, Sumner Avenue, North 14th Street, North 16th Street, Setliff Place, McKennie Avenue, Sharpe Avenue, Straightway Avenue, Franklin Avenue, Gallatin Avenue, Benjamin Street, Benson Street and Eastland Avenue, as being various Property Parcel Numbers as designated on Maps 083-010, 083-020, 083-030, 083-050, 083-060, 072-130 and 072-140 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is described by lines, words and figures on the documents that were duly considered by the Metropolitan Historic Zoning Commission, and which are on file with the Metropolitan Historic Zoning Commission and made a part of this ordinance as though copied herein.

Section 2. Be it further enacted, that the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet Nos. 083 and 072 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

Section 3. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:

I move to amend Ordinance No. BL2007-1501 as follows:
1. By deleting the phrase “130.49 acres”, wherein it appears in the caption and in Section 1 of the ordinance, and substituting in lieu thereof the phrase “111.0 acres”.

2. By deleting the parcels from the Neighborhood Conservation Overlay listed on the document attached hereto and incorporated herein as Exhibit A to this Amendment.

3. By substituting the sketch referenced in Section 1 with the attached new sketch.
