An ordinance authorizing the conveyance of a water line and associated easement to the Madison Utility District, initially with relation to Project No. 06-WG-0101, Madison Utility (Proposal No. 2006M-221G-04).

WHEREAS, it is in the public interest that the Metropolitan Government donate a water line and associated easement as described in Exhibit 1, attached hereto and incorporated herein, to the Madison Utility District in order to provide for fire protection to the Dry Creek Wastewater Treatment Plant (the “Project”); and

WHEREAS, Project No. 06-WG-0101, Madison Utility, has been funded under Capital Improvements Budget No. 99SC0005; and

WHEREAS, the Metropolitan Planning Commission approved this conveyance on February 8, 2007.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The Metropolitan Government of Nashville and Davidson County, by and through, the Director of Public Property Administration is hereby authorized to execute the necessary documents and convey the water line and easement contemplated herein and as shown in Exhibit 1 attached hereto and incorporated herein.

Section 2. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
