ORDINANCE NO. BL2007-1474

An ordinance authorizing the abandonment of an 8” sanitary sewer line and easement and the acceptance of a replacement 8” sanitary sewer line and a 6” water line and authorizing the execution of the necessary documents (Proposal No. 2006M-197U-12).

WHEREAS, an 8” existing sanitary sewer line and easement, more particularly described in Project No. 05-SL-55/05-WL-63, The Woodlands, Phases 1B, 2 & 3 (the “Project”) on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, the developer of the Project proposes to donate a replacement 8” sanitary sewer line and a 6” water line and associated easement to the Metropolitan Government of Nashville and Davidson County; and

WHEREAS, an easement for the replacement sewer line has been donated to the Metropolitan Government by plat;

WHEREAS, the Metropolitan Planning Commission has approved the abandonment and replacement contemplated herein and approved this mandatory referral No. 2006M-197U-12 on November 8, 2006.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the sanitary sewer line and easement and accepts the replacement 8” sanitary sewer line and a 6” water line and associated easement donated by the developer as shown on Map 172, Parcel 179.00, Project 05-SL-55/05-WL-63, The Woodlands, Phases 1B, 2 & 3, as indicated on Exhibit 1 attached hereto and incorporated herein, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute the necessary documents to carry out the said abandonment and replacement.

SECTION 2: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
