ORDINANCE NO. BL2007-1473

An ordinance authorizing the abandonment of a 8” sanitary sewer line and a 6” water line and two fire hydrants located at 63 Hermitage Avenue and authorizing the execution of the documents to carry out the abandonment (Proposal No. 2006M-233U-09).

WHEREAS, an 8” existing sanitary sewer line and accompanying easement, and a 6” water line (collectively, the “Lines”) more particularly described in Project No. 06-SL-0176 and 06-WL-0127, Metropolitan Nashville Fire Department Headquarters, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, the Lines are no longer needed by the Metropolitan Government and should be abandoned;

WHEREAS, the Metropolitan Planning Commission approved this mandatory referral No. 2006M-233U-09 on February 9, 2007 for abandonment of said easement and sanitary sewer line and water line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the sanitary sewer line and the easement and water line and two fire hydrants shown on Map 093-11, parcels 200 & 207, Project 06-SL-0176 and 06-WL-0127, Metropolitan Nashville Fire Department Headquarters, as indicated on Exhibit 1 attached hereto and incorporated herein, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute the necessary documents to carry out the abandonment.

SECTION 2: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
