ORDINANCE NO. BL2007-1472
An ordinance authorizing the abandonment of a 20’ sanitary sewer line and easement located at 5018, 5022, 5102, 5106, 5110, and 5116 Buena Vista Pike and authorizing the execution of the documents to carry out the abandonment (Proposal No. 2006M-209U-03).
WHEREAS, a 20’ existing sanitary sewer line and accompanying easement, more particularly described in Project No. 97-SL-0099, Forest Vale Abandonment are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and
WHEREAS, it is in the public interest that the 20’ existing sanitary sewer line and accompanying easement be abandoned by the Metropolitan Government; and
WHEREAS, The Metropolitan Planning Commission has approved the abandonment contemplated herein and approved this mandatory referral No. 2006M-209U-03 on December 13, 2006.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1: That the Metropolitan Government hereby abandons the sanitary sewer line and the easement shown on Map 059-01, Parcels 028, 029, 030, 031, 032, and 033, Project 97-SL-0099, Forest Vale Abandonment as indicated on Exhibit 1 attached hereto and incorporated herein, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment.
SECTION 2: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
