An ordinance authorizing the acquisition of an easement for stormwater Project No. 04-D-00747 located at 251 Lovell Street (Proposal No. 2006M-199G-04).

WHEREAS, it is in the public interest that easements be acquired to permit the construction of or other use for stormwater management (the “Project”) within the area designated for the construction and operation of Project No. 04-D-00747, 251 Lovell Street; and

WHEREAS, pursuant to the documents collectively attached as Exhibit 1, certain easements have been offered to the Metropolitan Government of Nashville and Davidson County for use in connection with the Project;

WHEREAS, the Metropolitan Planning Commission approved the acquisition on December 18, 2006;

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The Metropolitan Government of Nashville and Davidson County, by and through the Director of Public Property Administration, is hereby authorized to accept the easements shown in Exhibit 1, attached hereto and incorporated herein, for use in connection with the Project.

Section 2. The easement shall be filed in the Office of the Register of Deeds.

Section 3. This ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
