ORDINANCE NO. BL2007-1456

An ordinance amending Section 13.32.120 of the Metropolitan Code of Laws to prohibit chain link fences along certain arterial and collector streets.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 13.32.120 of the Metropolitan Code of Laws be and the same is hereby amended as follows:

1. By deleting the catchline for Section 13.32.120 and substituting in lieu thereof the following new catchline:

"13.32.120 Barbed wire and chain link fences prohibited-Exceptions."

2. By adding the following new subsection C.:

"C. It is unlawful for any person to erect, install or maintain a chain link fence along the right-of-way of any arterial or collector street, as shown on the major street plan and/or the adopted collector street plan, within the downtown interstate loop. For purposes of this section, the “downtown interstate loop” means Interstate 65 (I-65) to the north, Interstate 24 (I-24) to the east, Interstate 65 (I-65) to the south and Interstate 40 (I-40) to the west. The provisions of this section shall not apply to temporary construction fencing, temporary tree protection fencing, temporary festival fencing or fencing around a place of incarceration.”

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
