ORDINANCE NO. BL2007-1455

An Ordinance amending Title 12 of the Metropolitan Code, Vehicles and Traffic, to make changes to the provisions currently set forth in the Code regarding transportation issues affecting Davidson County.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the codification of Title 12 of the Code of The Metropolitan Government of Nashville and Davidson County, Vehicles and Traffic, be and the same is hereby amended by amending Section 12.08.080 by deleting the second sentence in its entirety and by substituting instead the following:

Registration plates issues for passenger motor vehicles shall be attached to the rear of the vehicle.

Section 2. That the codification of Title 12 of the Code of The Metropolitan Government of Nashville and Davidson County, Vehicles and Traffic, be and the same is hereby amended by adding as a new Section 12.88, the following:

The Vice Mayor, with the assistance of the members of the Public Safety and the Transportation Committees, will create a working group whose responsibility will be to review, research, and determine the needs of Nashville and Davidson County as it pertains to mass transit. Members of this working group will include, but not be limited to, representatives from the various Metro agencies that currently have programs or services regarding transit, members of the Metropolitan Council, and representatives from groups in the area that have an interest in mass transit.

(b) The working group, in working on its statutory responsibility, will need to assess the following:
1. all programs currently on going in Nashville and Davidson County;
2. studies that have been completed regarding the needs of the City and County in regards to mass transit;
3. staffing responsibilities, budgetary needs, and existing contractual obligations that may be affected;
4. public funding requirements as well as potential sources of funding, including state and federal resources;
5. programs and services delivered by other cities similar in size to Nashville and Davidson County; and
6. current deficiencies in existing programs that need to be addressed;

(c) The working group will be responsible for reporting to the Mayor and the Metropolitan Council no later than January 31, 2008, of its recommendations.

Section 3. Be it further enacted, that this Ordinance shall take effect immediately after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:

I move to amend Ordinance No. BL2007-1455 by deleting Section 2 in its entirety and substituting in lieu thereof the following new Section 2:

“Section 2. That the codification of Title 12 of the Code of The Metropolitan Government of Nashville and Davidson County, Vehicles and Traffic, be and the same is hereby amended by adding the following new Chapter 12.88:

12.88 MASS TRANSIT WORKING GROUP

12.88.010 Mass transit working group established.
A. TheVice Mayor, with the assistance of the members of the Public Safety and the Transportation Committees, shall create a working group whose responsibility will be to review, research, and determine the needs of Nashville and Davidson County as it pertains to mass transit. Members of this working group shall include, but not be limited to, representatives from the various Metro agencies that currently have programs or services regarding transit, members of the Metropolitan Council, and representatives from groups in the area that have an interest in mass transit.
B. The working group shall assess the following:
1. all programs currently on going in Nashville and Davidson County;
2. studies that have been completed regarding the needs of the City and County in regards to mass transit;
3. staffing responsibilities, budgetary needs, and existing contractual obligations that may be affected;
4. public funding requirements as well as potential sources of funding, including state and federal resources;
5. programs and services delivered by other cities similar in size to Nashville and Davidson County; and
6. current deficiencies in existing programs that need to be addressed.
C. The working group shall submit a report regarding its recommendations to the Mayor and the Metropolitan Council no later than January 31, 2008.”
