WHEREAS, the Metropolitan Department of Water and Sewerage Services is concerned about the water quality in the Stones River in Davidson County, Tennessee; and

WHEREAS, the Corps of Engineers has designed a project to continuously release water into the Stones River below the J. Percy Priest Dam and other purposes for Davidson County, Tennessee; and

WHEREAS, the Corp of Engineers has the authority and capability and is willing to fund participation in cost sharing of the Section 1135 Project that will enable the regulated release of water from the dam.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the agreement between The United States Department of the Army and The Metropolitan Government of Nashville and Davidson County for construction of the J. Percy Priest Dam, Section 1135 Project in Nashville, Tennessee, a copy of which is attached hereto and incorporated herein, is hereby approved and the Metropolitan Mayor is authorized to execute the same.

SECTION 2: That any amendments, renewals or extensions of the terms of the agreement described in Section 1 shall be approved by Resolution of the Metropolitan Council.

SECTION 3: That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
