ORDINANCE NO. BL2007-1446

An ordinance to grant a temporary construction easement to Phillips Development, LLC (Proposal No. 2007M-079G-14).

Whereas, the Metropolitan park and greenway system enhances recreational opportunities for Davidson County residents and visitors; and,

Whereas, the Metropolitan Board of Parks and Recreation is improving the Property at 1014 Stones River Road recently acquired for use as a Nature Center; and,

Whereas, the Metropolitan Government proposes to grant to Phillips Development, LLC a temporary construction easement to enable the development of a road and construction of ADA compliant restroom facilities; and,

Whereas, this easement is located on the property described in Exhibit A; and

Whereas, Phillips Development, LLC has further agreed to construct the connection to Ravenwood Country Club as described in Exhibit B; and

Whereas, Metropolitan Board of Parks and Recreation and Phillips Development, LLC have agreed that the construction shall be limited to the scope herein described and disturbance to the site shall be kept to a minimum; and,

Whereas, it is in the best interest of the citizens of the Metropolitan Government to approve the granting of the temporary construction easement;

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

Section 1.  The Director of Public Property Administration is hereby authorized to grant a temporary construction easement to Phillips Development, LLC for the construction, maintenance of and permit use of the road for construction traffic as shown in Exhibit A and to execute the necessary documents pertaining thereto.  The term of said easement shall be for and through the completion of Phase I of the development as shown on the subdivision plan for Ravenwood Map 85, Parcels 213 and 7.  Said road will not be accepted for maintenance by Metro until final approval is granted by Public Works.

Section 2.  The Director of Public Property Administration is hereby authorized to grant a temporary construction easement to Phillips Development for the construction of ADA compliant restrooms, as shown in Exhibit C and which meet or exceed ADA standards and requirements.  Said construction shall be completed by no later than February 9, 2008.

Section 3.  This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
