ORDINANCE NO. BL2007-1442

An ordinance amending M.C.L. § 5.04.012 to increase the handling fee assessed by offices and departments of the Metropolitan Government for dishonored checks.

WHEREAS, the Metropolitan Government seeks to increase the handling fee for a dishonored check in an effort to reflect the actual administrative cost of forty dollars ($40.00); and,

WHEREAS, Tennessee Code Annotated § 47-29-102 prescribes the maximum handling fee to be assessed for a returned check is thirty dollars ($30.00); and,

WHEREAS, the Metropolitan Government currently assesses a ten dollar ($10.00) handling fee against the maker or drawer of any check that is dishonored; and,

WHEREAS, the current ten dollar handling fee is insufficient to pay for the administrative costs actually incurred by the offices and departments of the Metropolitan Government for handling returned checks;

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1.  M.C.L. § 5.04.012 shall be amended to substitute the phrase “thirty dollars ($30.00)” for the phrase “ten dollars.”

SECTION 2.   This ordinance shall take effect upon final passage, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
