ORDINANCE NO. BL2007-1441
An Ordinance setting rates for sewage transportation and treatment service provided by the Metropolitan Department of Water and Sewerage Services to other municipalities.
WHEREAS, the Metropolitan Government provides sewage transportation and treatment service by contract to other municipalities; and
WHEREAS, the Metropolitan Government’s contracts for sewage transportation and treatment with the cities of Belle Meade, Brentwood, LaVergne and Millersville have terminated, and efforts are underway to develop new contract with those customers; and
WHEREAS, the Metropolitan Government is required by law to establish rates for sewage transportation and treatment service such that users pay their proportionate share of the full costs incurred in the provision of the service; and
WHEREAS, the Department of Water and Sewerage Services engaged a nationally-recognized rate consultant to perform a study of the costs incurred by the Metropolitan Government in providing sewage transportation and treatment service to other municipalities and to develop rates representing the proportionate share of each, taking into account capital payments previously made; and
WHEREAS, the Metropolitan Council now desires to establish rates to be charged by the Department of Water and Sewerage services to the cities of Belle Meade, Brentwood, Millersville and LaVergne for the years 2007 through 2010.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The following rates per hundred cubic feet are hereby established as the rates to be charged by the Department of Water and Sewerage Services to the municipalities shown during the listed years:

Section 2. The Department of Water and Sewerage Services is directed to engage a rate consultant to assist in developing municipal customer rates reflecting proportionate share for subsequent years and to propose such rates for consideration by the Metropolitan Council.
Section 3. This Ordinance shall take effect from and after is enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
