ORDINANCE NO. BL2007-1437

An ordinance authorizing the Metropolitan Government to enter into Utility Relocation Contract No. 6272, with the State of Tennessee, Department of Transportation, to relocate certain facilities, located from the Harding Place Extension, Couchville Pike.

WHEREAS, the State of Tennessee, Department of Transportation plans to construct State Project No.  19084-2214-14, in Davidson County; and

WHEREAS, Metropolitan Department of Water and Sewerage Services plans to construct the utility work identified as Project No. 03-SG-128 and 03-WG-114, identified in Capital Improvement Budget, No. 96-SG-0005 and described in the attached Contract; and

WHEREAS, it is in the interest of the Metropolitan Government that this utility work be carried out in the State project; and

WHEREAS, pursuant to the terms of Utility Relocation Contract No. 6272, attached hereto as Exhibit A and incorporated herein, the Metropolitan Government will be reimbursed for actual engineering cost currently estimated to be $19,939.00.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Director of Water and Sewerage Services is hereby authorized to enter into Utility Relocation Contract No. 6272, with the Tennessee Department of Transportation, attached hereto as Exhibit A, and incorporated herein.

Section 2. That the Director of Water and Sewerage Services is hereby authorized to enter into any supplemental agreements necessary to implement the Local Government Investment Pool Program.

Section 3.         That this ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
