ORDINANCE NO. BL2007-1434

An Ordinance amending Chapter 6.80 of the Metropolitan Code to provide for the suspension of wrecker driver’s permits in certain circumstances.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.  That Chapter 6.80 of the Metropolitan Code is hereby amended as follows:

1.  By deleting the provisions of Section 6.80.460 in their entirety and substituting in lieu thereof the following new provisions:

6.80.460         Violations and penalties. 
A.  Anyone violating any of the provisions of this chapter shall be subject to a fine of fifty dollars.  Every day a violation of any provision of this chapter continues shall constitute a separate offense.
B.  In addition to any fine imposed pursuant to subsection A. of this section, the transportation licensing commission shall suspend the driver’s permit for any wrecker driver found guilty of violating subsections D or F of Section 6.80.450 as follows: 
1.  A first offense shall result in a one week suspension of the driver’s permit.
2.  A second offense shall result in a one month suspension of the driver’s permit.
3.  A third offense shall result in a one year suspension of the driver’s permit.”

2.  By amending Section 6.80.585 by adding the following new subsection C.:

“C. In addition to the imposition of a penalty pursuant to subsection A. of this section, the transportation licensing commission shall suspend the driver’s permit for any wrecker driver found guilty of violating subsections B, C, D, E, F, G, H, I or L of Section 6.80.580 as follows: 
1.  A first offense shall result in a one week suspension of the driver’s permit.
2.  A second offense shall result in a one month suspension of the driver’s permit.
3.  A third offense shall result in a one year suspension of the driver’s permit.”

Section 2.  This Ordinance shall take effect from and after is enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
