ORDINANCE NO. BL2007-1402

An ordinance amending Chapter 6.72 of the Metropolitan Code to require drivers of vehicles for hire to provide proof of CPR certification prior to obtaining a driver's permit from the Transportation Licensing Commission. 

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.      That Chapter 6.72 of the Metropolitan Code is hereby amended by amending Section 6.72.120 by adding the following new subsection C.5.:

“5. Proof of a valid cardiopulmonary resuscitation (CPR) certification and automated external defibrillator (AED) certification.”

Section 2.      That Chapter 6.72 of the Metropolitan Code is hereby amended by adding the following new section 6.72.195:

6.72.195.    CPR/AED certification.
A. Every driver granted a permit under this article shall maintain a valid cardiopulmonary resuscitation (CPR) and automated external defibrillator (AED) certification at all times.  Proof of such certification must be submitted at the time a permit application or permit renewal is filed. 
B. Drivers holding a valid driver's permit pursuant to this article at the time of enactment of this ordinance shall have sixty (60) days in which to obtain the certification required by subsection A. of this section.”

Section 3.      That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Amendment No. 1
To
Ordinance No. BL2007-1402

Mr. President:

            I move to amend Ordinance No. BL2007-1402 as follows:

1.  By amending Section 1 by deleting the section number “6.72.120” and substituting in lieu thereof the section number “6.72.110”.

2.  By amending Section 2 by deleting the phrase “sixty (60) days”, and substituting in lieu thereof the phrase “ninety (90) days”.

3.  By amending Section 1 by adding the following provision at the end of the new subsection C.5: 

“Any applicant that is physically unable to perform CPR shall be exempt from this requirement.  Proof of physical inability shall be submitted at the time the application is filed in order to qualify for this exemption.”

4.  By amending Section 2 by amending the new Code Section 6.72.195 by adding the following new subsection C.:

“C.  Drivers that are physically unable to perform CPR shall be exempt from the requirements of this section, provided proof of physical inability is submitted to the metropolitan transportation licensing commission.”
