ORDINANCE NO. BL2007-1400

An ordinance amending Chapter 11.26 of the Metropolitan Code to require property owners to remove graffiti from their property.  

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.      That Chapter 11.26 of the Metropolitan Code is hereby amended by adding the following new Section 11.26.025:

11.26.025   Property owner responsibility for graffiti removal.
A. No person or entity owning real property within the area of the metropolitan government shall allow graffiti that is visible from the public right-of-way or from any public or private property to remain upon any permanent structure located on the property for more than ten (10) days after being notified in writing by the metropolitan police department or the department of codes administration of the existence of the graffiti.
B. Failure by a property owner to remove graffiti upon written notice pursuant to subsection A. of this section shall result in a fifty dollar ($50.00) fine, with each day in excess of the ten days constituting a separate violation.”

Section 2.      That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
