ORDINANCE NO. BL2007-1392

An ordinance authorizing the Director of Public Property, or his designee, to accept and record easements in favor of the Metropolitan Government on certain parcels of property for use in the Harpeth River and Cumberland River greenway systems (Proposal No. 2007M-018G-06).

WHEREAS, the owners of the parcels of property (the "Properties") described in the document attached as Exhibit A to this ordinance have agreed to donate easements to the Metropolitan Government; and

WHEREAS, the easements will be used to construct, operate and maintain portions of the Harpeth and Cumberland River greenway systems; and

WHEREAS, each of the easements will be dedicated with a separate agreement substantially in the form of the document attached as Exhibit B to this ordinance; and

WHEREAS, the citizens of Nashville and Davidson County will benefit by accepting the donated easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Director of Public Property, or his designee, is authorized to accept and record easements from the owners of the parcels of property described in Exhibit A. Each of the easements shall be dedicated with a separate agreement substantially in the form of Exhibit B.

Section 2. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
