ORDINANCE NO. BL2007-1376

An ordinance authorizing the Metropolitan Government to participate with Centex Homes to provide public sewer service in Davidson County to Villas of Concord Place, Phase 6, Project No. 05-SL-47F.

WHEREAS, Centex Homes has expressed a desire to provide public sewer service in Davidson County, Tennessee, to a development known as Villas of Concord Place, Phase 6, Project No. 05-SL-47F; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerages, has built the Mill CreekTrunk Sewer Project No. 98-SG-13 anticipating participation from developers at $2,000.00 per connection towards the cost of the Project; and

WHEREAS, This project is deemed to benefit both parties and the general community, and Centex Homes agrees to pay an amount not to exceed $152,000.00, for a total of 76 townhome connections.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The participation agreement with Centex Homes, to provide public sewer services in Davidson County, Tennessee, to a development known as Villas of Concord Place, Phase 6, Project No. 05-SL-47F, attached hereto and incorporated herein, is hereby approved and the Director of Water and Sewerage Services is authorized to execute the same.

SECTION 2. That the $152,000.00 from Centex Homes will be deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No. 47335, for a total of 76 townhome connections.

SECTION 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
