An ordinance abandoning a 10' Public Utility Easement, that is shown on Map 094-16, Parcels 11, 12, 13, 14, 15, 16, and 17, Project 06-WG-0091, Spence Circle Abandonment, and authorizing the execution of the documents to carry out the abandonment (Proposal No. 2006M-139U-14).

WHEREAS, a 10' Public Utility Easement, more particularly described in Project No. 06-WG-0091, Spence Circle Abandonment, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2006M-139U-14 on August 31, 2006 for abandonment of said Public Utility Easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the Public Utility Easement shown on Map 094-16, Parcels 11, 12, 13, 14, 15, 16, and 17, Project No. 06-WG-0091, Spence Circle Abandonment as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: Any further amendments to this Legislation may be processed by Resolution.

SECTION 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
