ORDINANCE NO. BL2007-1325
An ordinance abandoning an 8" sanitary sewer line and easement that will be replaced by an 8" sanitary sewer line, and the removal of 51' of water main/fire service and 234' of fire hydrant lead and fire hydrant # 12788 that is shown on Map 161, Parcel 082.00, Project 06-SL-111 and 84-WL-118, Lowe's of Nashville, Nolensville Pike at Old Hickory Boulevard and authorizing the execution of the documents to carry out the abandonment (Proposal No. 2006M-208U-12).
WHEREAS, an 8" existing sanitary sewer line and accompanying easement, more particularly described in Project No. 06-SL-111 and 84-WL-118, Lowe's of Nashville, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and
WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2006M-208U-12 on November 16, 2006 for abandonment of said easement and sanitary sewer line and the removal of 51' of water main/fire service and 234' of fire hydrant lead and fire hydrant # 12788.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1: That the Metropolitan Government hereby abandons the sanitary sewer line and easement and the removal of 51' of water main/fire service and 234' of fire hydrant lead and fire hydrant # 12788 shown on Map 161, Parcel 082.00, Project No. 06-SL-111 and 84-WL-118, Lowe's of Nashville as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.
SECTION 2: Any further amendments to this Legislation may be processed by Resolution.
SECTION 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
