ORDINANCE NO. BL2007-1323

An ordinance abandoning a 66" storm sewer line and easement that will be replaced by a 72" storm sewer line, that is shown on Map 106-16, Parcels 46.01 and 46.02, Project 06-D-00466, Walgreens at Murfreesboro Road and Thompson Lane, 1081 and 1083 Murfreesboro Pike, and authorizing the execution of the documents to carry out the abandonment (Proposal No. 2006M-138U-11).

WHEREAS, an 66" existing storm sewer line and accompanying easement, more particularly described in Project No. 06-D-00466, Walgreens at Murfreesboro Road and Thompson Lane, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2006M-138U-11 on August 31, 2006 for abandonment of said easement and storm sewer line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the storm sewer line and the easement shown on Map 106-16, Parcels 46.01 and 46.02, Project No. 06-D-00466, Walgreens at Murfreesboro Road and Thompson Lane as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: Any further amendments to this Legislation may be processed by Resolution.

SECTION 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
