ORDINANCE NO. BL2007-1316

An ordinance amending Chapter 8.08 of the Metropolitan Code of Laws regarding the penalties for keeping or harboring a vicious dog within the area of the Metropolitan Government.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Chapter 8.08 of the Metropolitan Code of Laws be and the same is hereby amended by deleting Section 8.08.030 in its entirety and substituting in lieu thereof the following new Section 8.08.030:

"8.08.030 Vicious dogs prohibited.
A. It shall be unlawful for any person to keep or harbor a vicious dog within the area of the metropolitan government unless said dog is confined.
B. Upon being found in violation of the provisions of this section, the court may order that the person do one or both of the following:
1. Be precluded from owning, harboring, or having custody or control of companion animals for a period of time that the court deems reasonable.
2. Pay appropriate fines and fees."

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Amendment No. 1
To
Ordinance No. BL2007-1316

Mr. President:

I move to amend Ordinance No. BL2007-1316 by amending Section 1 by deleting subsection B. of Section 8.08.030, and substituting in lieu thereof the following new subsection B:

"B. In addition to the court actions set forth in section 8.08.060 of this chapter, upon being found in violation of the provisions of this section, the court may order that the person do one or both of the following:
1. Be precluded from owning, harboring, or having custody or control of companion animals for a period of time that the court deems reasonable.
2. Pay appropriate fines and fees."
