An ordinance abandoning an 8" sanitary sewer, 8" water line and easements that will be relocated in the right-of-way on Bedford Avenue, that is shown on Map 117-14, Parcels11-31 and 104-113, Project 04-SL-91 and 04-WL-79, Bedford Avenue/Abbott Martin Road, and authorizing the execution of the documents to carry out the abandonment and relocation (Proposal No. 2004M-112U-10).

WHEREAS, an 8" existing sanitary sewer and water line and accompanying easement, more particularly described in Project No. 04-SL-91 and 04-WL-79, Bedford Avenue/Abbott Martin Road, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, a sanitary sewer and water line of equal size will be replacing the existing 8" sanitary sewer and water line and easement; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2004M-112U-10 on November 11, 2004 for abandonment and relocation of said easement and sanitary sewer and water line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the 8" sanitary sewer, and water line and the easement shown on Map 117-14, Parcels11-31 and 104-113, Project No. 04-SL-91 and 04-WL-79, Bedford Avenue/Abbott Martin Road as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and relocation authorized by this ordinance.

SECTION 2: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
