An ordinance authorizing the Metropolitan Government to participate with LEGG Investments to provide public sewer service in Davidson County to Mill Creek Town Center Sewer Project No. 05-SL-32.

WHEREAS, LEGG Investments, has expressed a desire to provide public sewer service in Davidson County, Tennessee, to a development known as Mill Creek Town Center Sewer, Project No. 05-SL-32; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, has built the Mill Creek Trunk Sewer Project No. 98-SG-13 anticipating participation from developers at $2,000.00 per connection towards the cost of the Mill Creek Truck Sewer Project; and

WHEREAS, this project is deemed to benefit both parties and the general community, and LEGG Investments agrees to pay an amount not to exceed $292,000.00 for a total of 146 single-family home connection.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The participation agreement with LEGG Investments, to provide public sewer services in Davidson County, Tennessee, known as the Mill Creek Town Center Sewer, Project No. 05-SL-32, attached hereto and incorporated herein, is hereby approved and the Director of Water and Sewerage Services is authorized to execute the same.

SECTION 2. That the $292,000.00 is to be deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No. 47335.

SECTION 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
