An ordinance authorizing the acquisition of property by negotiation or condemnation, for purposes of acquiring an easement for use in public projects of the Metropolitan Government, initially with relation to Project No. 02-SG-77/02-WG-69, Bell Road at Smith Springs Road at J. Percy Priest Lake, Tract Nos. 737, 741, 742, and 755 granted by the Department of Army, Corps of Engineers (Proposal No. 2005M-100U-13).

WHEREAS, it is in the public interest that an easement be acquired to permit the constructing, maintaining, and operating a sanitary sewer and/or appurtenances within the area designated for the construction of Project No. 02-SG-77/02-WG-69, Bell Road at Smith Springs Road granted by the Department of Army, Corp of Engineers.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. The Director of Public Property Administration, or his designee, is hereby authorized to acquire by negotiation or condemnation the following described easement for the purpose of constructing, maintaining and operating a sanitary sewer and/or appurtenances, the initial such project being Project No. 02-SG-77/02-WG-69, Bell Road at Smith Springs Road, the same being for a public purpose and the public convenience requiring it.

SECTION 2. The easement to be acquired from the U.S. Department of Army, Corps of Engineers, is shown on the plans for Project No. 02-SG-77/02-WG-69, Bell Road at Smith Springs Road, on record in the Office of the Director of the Department of Water and Sewerage Services and incorporated herein, and is described in Exhibit A, attached hereto and incorporated herein.

SECTION 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
