ORDINANCE NO. BL2006-939
An ordinance abandoning an 8 inch water line and easement that will be replaced by an 8 inch water line, that is shown on Map 161, Parcels 260 and 265, Project 05-WL-0117, Nipper's Corner Phase Two, and authorizing the execution of the documents to carry out the abandonment (Proposal No. 2005M-197U-12).
WHEREAS, an 8 inch existing water line and accompanying easement, more particularly described in Project No. 05-WL-0117, Nipper's Corner Phase Two, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and
WHEREAS, a water line of equal size will be replacing the existing 8 inch water line and easement; and
WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2005M-197U-12 on October 14, 2005 for abandonment of said easement and water line.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1: That the Metropolitan Government hereby abandons the 8 inch water line and the easement shown on Map 161, Parcel 260 and 265, Project No. 05-WL-0117, Nipper's Corner Phase Two as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.
SECTION 2: That
this ordinance shall take effect from and after its final passage, the
welfare of The Metropolitan Government of Nashville and Davidson County requiring
it.
