An ordinance abandoning an 8" sanitary sewer line and an 8" water line and easement that will be replaced by an 8" sanitary sewer line and an 8" water line and the installation of two fire hydrants, that is shown on Map 134, Parcel 63, Project 06-SL-59/06-WL-60, Providence Park, Phase 3, Providence Park Lane and authorizing the execution of the documents to carry out the abandonment and relocation (Proposal No. 2006M-131U-12).

WHEREAS, an 8" existing sanitary sewer line and an 8" water line and accompanying easement, more particularly described in Project No. 06-SL-59/06-WL-60, Providence Park, Phase 3, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2006M-131U-12 on August 30, 2006 for abandonment of said easement and sanitary sewer and water line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the sanitary sewer line and the easement shown on Map 134, Parcel 63, Project No. 06-SL-59/06-WL-60, Providence Park, Phase 3 as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: Any further amendments to this Legislation may be processed by Resolution.

SECTION 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
