ORDINANCE NO. BL2006-1266

An ordinance amending Ordinance No. BL2006-1093 by reinstating the waiver of fees for processing credit or debit card payments when collecting real property taxes paid by property owners 62 years of age or older.

WHEREAS, Tennessee Code Annotated § 9-1-108 currently mandates local governments to set and collect a credit or debit card processing fee in an amount that is equal to an amount paid to a third-party processor and does not exceed five percent (5%) of the amount of the payment collected; and

WHEREAS, Tennessee Code Annotated § 9-1-108 was amended by Chapter 348 of the Public Acts of 2001 to authorize a metropolitan government to waive the collection of a processing fee for accepting payment by use of credit or debit cards; and

WHEREAS, Ordinance No. BL2001-777 was adopted to waive the fee for processing credit card or debit card payments when collecting funds on behalf of the Metropolitan Government; and

WHEREAS, Ordinance No. BL2006-1093 repealed the waiver of such processing fees, except in the case of point of sale transactions; and

WHEREAS, although point of sale transactions are exempt from the credit processing fee under Ordinance No. BL2006-1093, certain senior citizens that desire to pay their property taxes by debit or credit card are unable to physically present the payment "over the counter" at the Trustee's Office; and

WHEREAS, it is in the best interest of the Metropolitan Government that the waiver of such processing fees be reinstated for property owners age 62 and over paying their property taxes by credit or debit card.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Ordinance No. BL2006-1093 is hereby amended by amending Section 2 by adding after the phrase "except in the case of point of sale transactions", the phrase "or when property owners sixty-two (62) years of age or older are paying their annual real property taxes to the Office of the Trustee".

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
