ORDINANCE NO. BL2006-1265

An ordinance amending Chapter 4.12 of the Metropolitan Code of Laws to prohibit any person contracting with Metropolitan Government to provide background checks on prospective or existing Metropolitan Government employees from selling, transferring or transmitting information obtained to a third party.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Chapter 4.12 of the Metropolitan Code of Laws be and the same is hereby amended by adding the following new Section 4.12.230:

"4.12.230 Contracts relating to background checks on prospective and existing employees.

A. Any person entering into any contractual agreement with the metropolitan government for any type of background check or investigatory research on prospective or existing employees of the metropolitan government shall be prohibited from selling, transferring or transmitting any information obtained about any prospective or existing employee to any person or firm other than an officer or agent of the metropolitan government.

B. The purchasing agent, or other agency of the metropolitan government under whose jurisdiction such services are to be provided, shall include in the invitations to bid or requests for proposals, a clause prohibiting the successful bidder or proposer from selling, transferring or transmitting any information obtained about any prospective or existing employee to any person other than an officer or agent of the metropolitan government.
C. Any contractor who violates the provisions of this section is subject to debarment or suspension pursuant to Section 4.36.020. Authority to debar or suspend shall be in addition to any contractual remedies available to the metropolitan government."

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
