ORDINANCE NO. BL2006-1264

An ordinance authorizing the acquisition of certain interests in real property, granting certain easements, and abandoning certain easements as herein described in connection with an expansion of the West Nashville Police Station and improvements to H.G. Hill Park (Proposal No. 2006M-196U-07).

WHEREAS, it is in the public interest for the Metropolitan Government to acquire certain property, grant certain easements, and abandon certain easements in connection with the expansion of the West Nashville Police Station and improvements to H.G. Hill Park; and,

WHEREAS, the Metropolitan Government has negotiated the purchase of a portion of a parcel of property located on Davidson County Tax Map 102, Parcel 26, and described in the documents incorporated herein as Exhibit 1 and Exhibit 2; and,

WHEREAS, pursuant to the terms of the document incorporated herein as Exhibit 2, the Metropolitan Government has obtained an option to purchase the Property described in Exhibit 1 and Exhibit 2; and,

WHEREAS, the temporary construction easements incorporated herein as Exhibits 3 and 4 should be granted to Nashville West Shopping Center, LLC; and,

WHEREAS, the permanent easements described in the documents incorporated herein as Exhibits 5 and 6 should be granted to Nashville West Shopping Center, LLC; and,

WHEREAS, the easement described in the documents incorporated herein as Exhibit 7 should be granted to Nashville Electric Service; and,

WHEREAS, the easements described in the documents incorporated herein as Exhibits 8 and 9 should be dedicated as public utility and drainage easements; and,

WHEREAS, the easement described in the documents incorporated herein as Exhibit 10 should be dedicated as a public drainage easement; and,

WHEREAS, an 8" existing sanitary sewer line and accompanying easement, described in the documents incorporated herein as Exhibit 11, are no longer being used by the Department of Water and Sewerage Services nor any other public utility and should be abandoned; and,

WHEREAS, a sanitary sewer line of equal size will replace the existing 8" sanitary sewer line and easement described in the documents incorporated herein as Exhibit 11; and,

WHEREAS, The Metropolitan Planning Commission approved this abandonment of the easement and sanitary sewer line described in the documents incorporated herein as Exhibit 11 pursuant to mandatory referral No. 2006M-024U-07 on February 23, 2006.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Director of Public Property, or his designee, is hereby authorized to exercise the Fee Simple Acquisition Option described in the documents incorporated herein as Exhibits 1 and 2, and to execute such documents as may be necessary to effect the acquisition of the property by the Metropolitan Government.

Section 2. That the Metropolitan Government hereby grants the temporary construction easements described in the documents incorporated herein as Exhibits 3 and 4 to Nashville West Shopping Center, LLC, and the Director of Public Property, or his designee, is authorized to execute such documents as may be necessary to carry out the disposition of the property by the Metropolitan Government.

Section 3. That the Metropolitan Government hereby grants the permanent easements described in the documents incorporated herein as Exhibits 5 and 6 to Nashville West Shopping Center, LLC, and the Director of Public Property, or his designee, is authorized to execute such documents as may be necessary to carry out the disposition of the property by the Metropolitan Government.

Section 4. That the Metropolitan Government hereby grants the easement described in the documents incorporated herein as Exhibit 7 to the Nashville Electric Service, and the Director of Public Property, or his designee, is authorized to execute such documents as may be necessary to carry out the disposition of the property by the Metropolitan Government.

Section 5. That the Metropolitan Government hereby dedicates the easements described in the documents incorporated herein as Exhibits 8 and 9 as public utility and drainage easements, and the Director of Public Property, or his designee, is authorized to execute such documents as may be necessary to carry out the disposition of the property by the Metropolitan Government.

Section 6. That the Metropolitan Government hereby dedicates the easement described in the documents incorporated herein as Exhibit 10 as a public drainage easement, and the Director of Public Property, or his designee, is authorized to execute such documents as may be necessary to carry out the disposition of the property by the Metropolitan Government.

Section 7. That the Metropolitan Government hereby abandons the 8" sanitary sewer line and the easement described in the documents incorporated herein as Exhibit 11, and the Director of Water and Sewerage Services and the Director of Public Property Administration, or their designees, are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 8. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
