ORDINANCE NO. BL2006-1251

An ordinance abandoning a 12" water line and easement that will be replaced by a 10" water line and 2 fire hydrants, that is shown on Map 147, Parcel 038.00, Project 05-WL-0213, Wal-Mart, Nolensville Pike at Harding Place, 4050 Nolensville Pike and authorizing the execution of the documents to carry out the abandonment (Proposal No. 2006M-095U-12).

WHEREAS, a 12" existing water line and accompanying easement, more particularly described in Project No. 05-WL-0213, WalMart, Nolensville Pike at Harding Place, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, a 10" water line and easement and 2 fire hydrants will be replacing the existing said water line and easement; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2006M-095U-12 on August 4, 2006 for abandonment of said easement and water line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the water line and the easement shown on Map 147, Parcel 038.00, Project No. 05-WL-0213, WalMart, Nolensville Pike at Harding Place, as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
