ORDINANCE NO. BL2006-1238

An ordinance amending Chapter 13.08 of the Metropolitan Code of Laws regarding abandoned property within the public right-of-way, all of which is more particularly described herein.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Chapter 13.08 of the Metropolitan Code of Laws is hereby amended by adding the following new Section 13.08.080:

"13.08.080 Abandoned property.
A. For purposes of this section, "abandoned property" means personal property, other than motor vehicles, which the owner voluntarily places within the public right-of-way for a duration of more than twenty-four (24) hours without obtaining a permit required by section 13.16.010 of this title.
B. No person shall leave or place abandoned property within the public right-of-way. Any abandoned property left within the public right-of-way in violation of this section is declared to be damaging to the health, safety and welfare of the residents of the metropolitan government.
C. Any abandoned property within the public right-of-way shall be removed by the department of public works and stored until disposed of as provided herein.
1. Abandoned property of no monetary value may be disposed of by the department of public works immediately.
2. If the abandoned property is believed to have any monetary value, the department of public works shall attempt to locate the owner of said property.
3. Any abandoned property stored by the department of public works for more than thirty (30) days without being claimed shall be disposed of in the same manner as surplus property of the metropolitan government pursuant to chapter 4.32 of the metropolitan code of laws."

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
